Law Practice

Shane Swilley’s practice focuses on employment and business litigation in the state and federal courts. He additionally provides advice and counsel to clients and businesses on employment and labor law issues.
 

Employment and Labor Law - Representing clients and businesses in connection with claims of discrimination, retaliation, sexual harassment, civil rights, breach of contract, unpaid wage, and wrongful discharge.  Shane's accomplishments include:

  • Successfully defended an employer against claims of wrongful discharge and unpaid wages by getting the claims dismissed as a matter of law.
  • Assisted in defending an employer against claims of unlawful discrimination and retaliation. The unlawful discrimination claims were dismissed on summary judgment, and the remaining claims were tried to a defense verdict in the United States District Court for the District of Oregon.
  • Persuaded plaintiff to dismiss voluntarily all claims of unlawful discrimination and retaliation against an employer after filing a motion for summary judgment.
  • Assisted in successfully representing a high level civil service employee of the Army Corps of Engineers in challenging his removal from federal service. The case lasted more than two years and was appealed to the Court of Appeals for the Federal Circuit in Washington D.C.  It resulted in the client being reinstated to his job and recovering back pay and attorney fees.
  • Represented defendants and plaintiffs in disputes involving noncompetition agreements and claims of misappropriation of trade secrets and confidential information.

Business and Commercial Litigation - Handling a variety of business and commercial litigation matters, including:

  • Interference with economic relations.
  • Breach of fiduciary duty.
  • Partnership disputes.
  • Misappropriation of trade secrets.
  • Breach of contract.

Education & Bar Admissions

Shane earned his bachelor’s degree from Willamette University in 2000.  He earned his law degree from Lewis and Clark Law School in 2005, where he was the Student ABA Representative and represented the school on its Regional Moot Court Negotiations Competition Team.

Shane was admitted to the Oregon State Bar in 2005 and the U.S. District Court for the District of Oregon in 2006.

Professional Activities

Shane’s professional memberships include the Multnomah Bar Association, and the Labor & Employment and Business Law sections of the Oregon State Bar.

Community Activities and Interests

Shane’s volunteer activities include involvement in the MBA Young Lawyers’ section, and participating in charity fun-runs.  Shane enjoys spending his free time golfing and hiking.
